Please read these Terms of Service ("Terms") carefully before using the MODE application and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Use of the Service
MODE provides an AI-powered fitness coaching platform that connects users with personalized coaching experiences configured by personal trainers. The Service is available to users who are 13 years of age or older. By using the Service, you represent that you meet this age requirement.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to any part of the Service or its systems
- Transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means to access or scrape any part of the Service
- Impersonate any person or entity
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@modefit.ai if you suspect unauthorized access to your account.
3. Not Medical Advice
The Service is designed to support fitness coaching and general wellness. It is not intended to provide medical advice, diagnosis, or treatment. AI-generated coaching responses are not a substitute for professional medical, nutritional, or mental health advice, diagnosis, or treatment.
Always seek the advice of a qualified health professional before beginning any new fitness or nutrition program, especially if you have any pre-existing medical conditions, injuries, or concerns. If you experience pain, injury, or a medical emergency, stop activity immediately and seek appropriate professional care.
MODE includes safety features designed to surface potential injury or health concerns to your assigned trainer. These features are supplementary and do not constitute medical monitoring or clinical oversight.
4. AI-Generated Content
Coaching responses within the Service are generated by artificial intelligence systems. While we work to ensure these responses are helpful and appropriate, AI-generated content may contain errors, inaccuracies, or limitations. You should apply your own judgment when acting on any AI-generated coaching advice.
We reserve the right to modify, improve, or change the AI systems used to generate responses without notice.
5. Trainer Relationship
MODE facilitates a coaching relationship between you and your assigned personal trainer. The trainer configures the AI coaching persona and may review flagged conversations and insights. The trainer is an independent professional and is not an employee or agent of MODE. MODE is not responsible for the professional advice, programming, or actions of individual trainers.
6. Intellectual Property
The Service, including its design, software, features, and content, is owned by MODE and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works based on any part of the Service without our prior written permission.
You retain ownership of content you submit to the Service. By submitting content, you grant MODE a non-exclusive, worldwide, royalty-free license to use, process, and display that content for the purpose of providing and improving the Service.
7. Termination
We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms. You may discontinue use of the Service at any time and request account deletion by contacting hello@modefit.ai.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MODE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the effective date. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
